GENERAL CONDITIONS OF SALE
The goods covered by these general conditions are offered for sale by Taliani Giuseppe SAS – via Toscana 5, Pontedera 56025 (PI), registered with the Chamber of Commerce of Pisa on 27-5-99 at no. 0149 0860 507. The offer and sale of products is carried out on the website www.talianiferroshop.com
are governed by these General Conditions of Sale.
The Customer is required, before submitting his/her purchase order, to carefully read these General Conditions of Sale. Submitting the purchase order implies full knowledge and express acceptance of both the aforementioned General Conditions of Sale and of what is indicated in the online Order Form.
OBJECT
- These General Conditions of Sale have as their object the sale of products carried out online via the electronic commerce service on the site www.talianiferroshop.com which for convenience we will hereinafter define as the "Site".
- The products sold on the site can be purchased and delivered exclusively in the countries indicated in the online Order Form.
SUBJECTS
- The products are sold directly by Taliani Giuseppe SAS – via Toscana 5, Pontedera 56025 (PI) and these General Conditions of Sale regulate the offer, forwarding and acceptance of purchase orders only for products found on the website www.talianiferroshop.com and not on other websites owned by Taliani Giuseppe SAS.
- The products are sold to the Customer identified by the data entered when completing and sending the Order Form in electronic format with simultaneous acceptance of these General Conditions of Sale.
- By accepting these Conditions of Sale, the Customer exempts Taliani Giuseppe SAs from any liability arising from the issuing of incorrect tax documents due to errors resulting from incorrect compilation of the form by the Customer.
- The customer is prohibited from entering false names in the online ordering procedure. Taliani Giuseppe SAS reserves the right to legally pursue any violation and abuse.
- The products on the Site are intended for adult customers. By placing an order through this Site, the Customer declares that he or she is at least 18 years old and has the legal capacity to enter into binding contracts.
SALES THROUGH ELECTRONIC COMMERCE SERVICE
- By online sales contract we mean the distance contract having as its object the sale of products stipulated between the Customer and the company Taliani Giuseppe SAS, with the site www.talianiferroshop.com
- To conclude the purchase contract, it is necessary to fill out the Order Form in electronic format and send it to Taliani Giuseppe SAS via the Internet according to the relevant instructions.
- The Order contains:
- a reference to the General Conditions of Sale;
- information and/or images of each Product and the relative price;
- the payment methods available to the Customer;
- the methods of delivery of the products and the related shipping costs;
- The photographic representation of the products on the Site has the sole purpose of presenting them to the Customer for sale, without any guarantee or commitment by Taliani Giuseppe SAS, regarding the exact correspondence of the image depicted on the Site with the actual product; and this, with particular regard to its actual dimensions, accessories and/or the chromatic aspects of the products and/or packaging.
- The sales contract will be considered concluded upon confirmation of receipt of the order, sent by Taliani Giuseppe SAS to the email address indicated by the customer.
- The Customer, in the manner and time established, will make the payment of the total amount of the Products and related services, indicated in the Purchase Order.
- In any case, the shipment of the products will take place exclusively following the correct crediting of the entire agreed amount.
- If payment for the Products is not made within the time limit, in the manner or for the amounts provided, the Sales Contract will be automatically terminated and void of any effect.
- The language available to conclude the contract with Taliani Giuseppe SAS is Italian and the applicable law is Italian.
ORDER EVASION
- Once the contract has been concluded, Taliani Giuseppe SAS will send, by email, an Order Confirmation, containing a summary of the information already contained in the Order.
- Before sending the Order Confirmation, Taliani Giuseppe SAS reserves the right to request additional information from the Customer in relation to the Order sent. If the Customer fails to provide the Seller with the additional information requested, the Seller reserves the right not to accept the order sent.
- Taliani Giuseppe SAS may not process orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products. In these cases, it will inform the Customer by email. In this case, the amount charged to the customer will be refunded by bank transfer.
- Each sale made by Taliani Giuseppe SAS through the online sales service may concern one or more products, with no quantity limit for each item.
- If the products presented on the website are no longer available or on sale after the Order has been sent, Taliani Giuseppe SAS will promptly communicate the possible unavailability of the ordered Products. In this case, the amount charged to the Customer will be refunded by bank transfer to the current account indicated by the Customer.
- Taliani Giuseppe SAS reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous order.
SELLING PRICES
- All prices of the Products and shipping and delivery costs indicated on the Site and in the Order are to be considered VAT included and expressed in Euros. The validity of the prices indicated is always and only that indicated by the Site at the time of transmission of the Order via the Internet. The prices of the Products and shipping and delivery costs may vary without prior notice. The Customer is required to ascertain the final sale price before sending the relevant Order.
- All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the Site and in the Order, unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes if the shipment takes place in non-EU countries or in countries where the current legislation provides for import charges. These costs are therefore borne by the Customer and must be paid directly upon delivery of the Products, according to the instructions specified in the Order Confirmation.
PAYMENT METHODS
Each payment by the Customer may be made exclusively according to one of the methods indicated in the order form and which are summarised in the following articles.
Credit cards and prepaid cards
Taliani Giuseppe SAS accepts payments made with the following credit cards and prepaid cards: Visa, Mastercard, American Express, without applying any additional charge to the price of the product or shipping. It is understood that the Customer must be the holder of a valid credit card at the time of purchase and that the name on the credit card must be the same as the one indicated on the billing information.
At the time of online purchase, at the same time as the Order Confirmation, the relevant banking institution will charge the amount relating to the order to the Customer's credit card.
Once the order has been processed (therefore after having instructed the Courier for the shipment), if the Customer intends to avail himself of the Right of Withdrawal, Taliani Giuseppe SAS will instruct the relevant banking institution to credit the amount to be refunded via bank transfer to the current account indicated by the Customer.
Bank transfer
Taliani Giuseppe SAS accepts payments made by bank transfer to the IBAN IT 37 W 03440 14000 000006191000 in the name of Taliani Giuseppe SAS and indicated in the order confirmation email. The reason for payment made by bank transfer must include the following wording "ECOMMERCE ORDER PAYMENT + order number" as better specified in the confirmation email.
Payment must be made by the Customer no later than 7 days from the date of receipt of the order confirmation email. After this deadline for making the payment, Taliani Giuseppe SAS will be authorized to cancel the order placed by the Customer.
In any case, the shipment of the products will take place exclusively following the correct crediting of the entire agreed amount.
COLLECTION IN WAREHOUSE
The preparation times for an order vary from 2 to 10 working days. The products can be collected by the customer in a single solution at one of the warehouses indicated during the purchase of the product.
Dimensions, weight, volume of the goods and other information (pallets, packaging etc.), can be provided to the customer, upon request via email only after the material has been prepared; this will help the customer to use a suitable means of transport for loading the goods.
After confirming receipt of the order, the customer will receive an email notification to collect the goods. The customer who placed the order must show up with an identity document or a different person but with a signed authorization and a copy of the identity document of the person who placed and paid the order.
The customer must collect the products within 48 hours of the collection notice by email; after this period and until the thirtieth day, Taliani Giuseppe SAS will store and keep the material at the chosen warehouse but will charge the customer the storage costs at the time of collection. The storage costs are quantifiable as €2 per day for each package starting from the third day from the receipt of the email of goods ready for collection.
After 30 days from receipt of the notice that the goods are ready without the customer having collected the goods, the sales contract will be considered terminated and the relative price refunded to the Customer using the payment method used during the purchase phase, less the preparation and storage costs.
SHIPPING AND DELIVERY
Each shipment contains:
- the products/products ordered
- the relevant transport document/accompanying invoice/receipt
- any documentation required based on the country of shipment
- any information and marketing material
The delivery of the ordered goods will take place at the address indicated by the customer on the order using a courier or transporter identified by Taliani Giuseppe SAS. The customer will verify that the information relating to the delivery address is correct. The preparation times for an order vary from 2 to 10 working days.
When the goods are taken over by the courier, Taliani Giuseppe SAS will upload the shipment tracking to the customer area; the customer will thus be able to monitor the progress of the goods purchased by him.
Shipping costs and related additional services will be indicated in the order confirmation; if this is not possible or in the case of particularly bulky/heavy products, the customer will be promptly contacted to define the actual delivery costs.
Unless otherwise explicitly indicated, delivery is intended to be at street level (at the destination street number). Upon receipt of the goods at the address indicated during the purchasing phases, the customer is required to verify:
- the integrity of the delivered packages, packaging and closing materials
- the correspondence of the number of packages delivered to that indicated in the transport document
In the event of anomalies, the Customer must immediately contest them by writing “Accepted with reservation” on the courier’s delivery receipt. Otherwise, the possibility of raising any dispute with Taliani Giuseppe SAS regarding the quantity and integrity of what was received will lapse.
Any impediments or difficulties relating to delivery must be communicated by the customer at the time of purchase order, in the "notes" field; in default, the goods cannot be delivered and Taliani Giuseppe SAS may charge the customer the cost incurred for the failure to deliver and storage of the goods.
Shipments to Venice Lagoon and Minor Islands
For shipments to Venice Lagoon and smaller islands , the customer will be contacted by our customer service to verify the possibility of shipping. If shipping is possible, a supplement will be requested for the purpose of processing the order. If shipping is not possible or the supplement is not accepted, the customer will have the right to freely cancel the order.

RIGHT OF WITHDRAWAL
- Pursuant to art. 52 et seq. of the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments), the consumer customer (meaning the definition provided for by art. 3 of the Consumer Code, or "any natural person who acts on the site for purposes other than any entrepreneurial or professional activity carried out"), has the right to withdraw from the contract concluded with Taliani Giuseppe SAS, without any penalty, for any reason and without the need to provide any explanation, within 14 (fourteen) working days, starting from the day of receipt of the products purchased on the site.
- The right of withdrawal can be exercised by sending the request via email to info@talianiferroshop.com and the customer will also receive all the information necessary for returning the goods via email.
- The right of withdrawal is subject to the following conditions:
- the returned goods must be returned in their entirety and not in parts or components of them, even in the case of kits;
- the returned goods must not have been used or damaged
- The returned goods must be returned in their original packaging if present
- the returned goods must be sent to Taliani Giuseppe SAS in a single shipment
- the returned goods must be delivered to the courier within 14 (fourteen) working days from the date on which the customer received the goods
- Taliani Giuseppe SAS reserves the right not to accept returned goods if the return does not comply with the terms and conditions set out in the return policy. In this case, the communication will arrive from the email info@talianiferrshop.it and it will be possible to choose whether to have the purchased products sent back, at your own expense, or, otherwise, Taliani Giuseppe SAS will retain the items without refunding the related cost.
- If the right of withdrawal is exercised in accordance with the previous conditions, Taliani Giuseppe SAS is required to refund the sums paid by the customer within and no later than 14 (fourteen) working days from receipt of the returned products (the time frame within which the refund will be visible on the customer's current account depends on the bank).
- In compliance with current legislation, in the event of a return, the costs of returning the product are borne by the Customer.
- Taliani Giuseppe SAS undertakes to cover the shipping costs of the products exclusively in cases where the products are damaged at the time of delivery due to transport or errors have occurred in the shipment by the seller. In this case, the customer will be contacted to agree on the times and methods of collection and Taliani Giuseppe SAS will send an express courier to collect the goods at the address indicated by the Customer.
- For the return, the Customer must use exclusively the Courier indicated by Taliani Giuseppe SAS: the payment of the costs of returning the purchased products to be borne by the Customer will be made directly by Taliani Giuseppe SAS. At a later time, Taliani Giuseppe SAS, with the exception of the provisions of the previous point 6 and for cases of return due to a product defect, will withhold from the refund due a lump sum equal to the cost previously incurred for shipping and home delivery of the products purchased by the customer, or the shipping costs normally envisaged for the country of delivery. Furthermore, from the moment of return of the purchased products to the carrier, Taliani Giuseppe SAS exonerates the customer from any liability in the event of loss or damage to the products during transport.
- In case of exercising the right of withdrawal, Taliani Giuseppe SAS will transfer the amount to the current account indicated by the Customer.
- In the event of exercising the right of withdrawal without complying with the methods indicated above, Taliani Giuseppe SAS will resend the purchased goods, also charging the additional shipping costs.
- The right of withdrawal cannot be applied in the case of customized or made-to-measure products requested by the customer when placing the order.
WARRANTY OF NON-CONFORMING PRODUCTS
Pursuant to Legislative Decree 206/2005 Consumer Code, all Products on sale on the Site are covered by the legal guarantee in favor of the consumer, in the event of a lack of conformity. If the Customer has entered into the contract as a consumer (this definition being understood as any natural person who acts on the site for purposes other than any entrepreneurial or professional activity carried out), this guarantee is valid provided that the following conditions are met:
- the defect occurs within the timeframes set by the legislation in force on the matter
- the customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was discovered by the latter
In the event of a lack of conformity, the consumer may ask Taliani Giuseppe SAS, alternatively and without charge:
- the replacement of the purchased product
- a reduction in the purchase price
All return costs for defective products will be borne by Taliani Giuseppe SAS.

CONTRACT STORAGE METHODS
Pursuant to art. 12 of Legislative Decree 70/2003, Taliani Giuseppe SAS informs the customer that each order sent will be stored in digital/paper form on the server/at the Taliani Giuseppe SAS headquarters according to confidentiality and security criteria.
PRIVACY
The customer undertakes to receive information on the methods of processing personal data by accessing the Privacy section of the site to which express reference is made.
APPLICABLE LAW, DISPUTE RESOLUTION AND JURISDICTION
These General Conditions of Sale are governed by Italian law and will be interpreted in accordance with it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the customer. Consequently, the interpretation, execution and resolution of the general conditions of sale are subject exclusively to Italian law and any disputes inherent and/or consequent to the same must be resolved exclusively by the Italian judicial authority.
In particular, if the customer is a consumer, any disputes must be resolved by the court of the place of domicile or residence of the same in accordance with the applicable law or, at the consumer's choice in the event of action taken by the consumer himself, by the Court of Pisa. If the Customer acts in the exercise of his entrepreneurial, commercial, artisanal or professional activity, the parties consensually establish the exclusive jurisdiction of the Court of Pisa.
MODIFICATION AND UPDATE
Taliani Giuseppe SAS may make changes or amendments to these conditions of sale at any time.
